Description: The American Civil Liberties Union of New Mexico on Thursday called for state authorities to investigate a small group of armed U.S. citizens who they alleged are illegally detaining migrants entering the United States. The United Constitutional Patriots, who claim to be mainly military veterans, have been patrolling the U.S.-Mexico border near Sunland Park, New Mexico, since late February in search of illegal border crossers. They post near daily videos showing members dressed in camouflage and armed with semi-automatic rifles holding groups of migrants, many of them Central American families seeking asylum, until U.S. Border Patrol agents arrive to arrest them. The small volunteer group says it is helping Border Patrol deal with a surge in undocumented migrants but civil rights organizations like the ACLU say it is a “fascist militia organization” operating outside the law. “We cannot allow racist and armed vigilantes to kidnap and detain people seeking asylum,” the ACLU said in a letter to New Mexico Governor Michelle Lujan Grisham and Attorney General Hector Balderas. “We urge you to immediately investigate this atrocious and unlawful conduct.” The offices of Lujan Grisham and Balderas did not respond to requests for comment. On a March 27 visit to El Paso, Texas, next to Sunland Park, then U.S. Customs and Border Protection (CBP) Commissioner Kevin McAleenan said his agency, which runs U.S. Border Patrol, did not need the help of citizens to police the border. “We are not asking for civil society groups to provide border security assistance,” said McAleenan, who was recently appointed acting secretary of the U.S. Department of Homeland Security. U.S. CBP did not respond to a request for further comment. UCP member John Horton did not immediately return calls. Horton has previously told media that UCP members are armed for self defense, as is their right under U.S. law, and aware they cannot detain people entering the United States illegally. U.S. armed groups have long patrolled the U.S. border, their numbers rising during upticks in migrant apprehensions, such as during the mid 2000s when the Minuteman Project was established. The UCP says it is responding to a rise in migrant arrests to their highest monthly levels in more than a decade. The ACLU said the group was a product of the Trump administration’s “vile racism” that “has emboldened white nationalists and fascists to flagrantly violate the law.”

Just days after Border Patrol apprehended 1,800 illegal immigrants in one day, the government of New Mexico and the ACLU are criticizing a citizen group patrolling the border. “It should go without saying that regular citizens have no authority to arrest or detain anyone,” New Mexico’s Democrat Governor Michelle Lujan Grisham told the New York Times. She also said it’s “completely unacceptable” that migrant families “might be menaced or threatened in any way, shape or form when they arrive at our border.” Meanwhile, the American Civil Liberties Union (ACLU) of New Mexico sent a letter to Governor Grisham and Attorney General Hector Balderas on Thursday asking for the group of patriots voluntarily patrolling the border to be investigated. Below is an excerpt of the letter in which they call the group, United Constitutional Patriots (UCP), “white nationalists” and “fascists.”
“Two nights ago, on April 16, 2019, an armed fascist militia organization describing itself as the United Constitutional Patriots arrested nearly three hundred people seeking safety in the United States, including young children, near Sunland Park, New Mexico. Other videos appear to show arrests in the past few hours.[1] The vigilante members of the organization, including Jim Benvie, who posted videos and photographs[2] of the unlawful arrests to social media, are not police or law enforcement and they have no authority under New Mexico or federal law to detain or arrest migrants in the United States. Their actions undermine the legitimate efforts of our state’s law enforcement officials to keep New Mexico families safe and they erode community trust. The Trump administration’s vile racism has emboldened white nationalists and fascists to flagrantly violate the law. This has no place in our state: we cannot allow racist and armed vigilantes to kidnap and detain people seeking asylum. We urge you to immediately investigate this atrocious and unlawful conduct.”
New Mexico Attorney General Hector Balderas bashed the group in a statement, saying, “These individuals should not attempt to exercise authority reserved for law enforcement.” A spokesperson for the civilian group, Jim Benvie, said the detention of illegals amounts to “a verbal citizen’s arrest,” which is basically a bluff used to stop border crossers until Border Patrol arrives. “We’re just here to support the Border Patrol and show the public the reality of the border,” Benvie insisted, adding, “Border Patrol has never asked us to stand down.” Infowars has covered UCP multiple times this week after they caught a group of over 300 illegals Tuesday night and another group of more than 90 on Wednesday. Patriot border patroller Conservative Anthony will join The War Room Friday at 4:30 P.M. CST for an exclusive interview where he’ll discuss the latest footage he’s captured, including over 70 buses arriving at the border and a “lookout” drone used by smugglers. At the 26:45 timestamp in the following video, a drone can be seen monitoring the border to ensure the illegals safe entry into the U.S. as they try to avoid Border Patrol or citizen patrols. “Lookout” drones are frequently used to assist smugglers who sneak illegal immigrants into the country. At the 26:30 timestamp, the next video shows what is reported to be a caravan of over 70 buses arriving into Anapra, Mexico in the middle of the night. While the government of New Mexico has its scope set on United Constitutional Patriots, the group vows to patrol the border until President Trump’s wall is built.

Otero County officials unanimously voted in favor of the declaration on Thursday, demanding the governor deploy National Guard troops to the area. Hundreds of migrants have been transported to shelters in the county, but those shelters are reportedly overflowing and the county’s resources are depleting. Otero officials are now giving the state a week to respond to their declaration, and plan on suing if they don’t help and provide resources. Meanwhile, U.S. Customs and Border Protection (CBP) agents in New Mexico apprehended nearly 2,000 migrants in just one day. Agents patrolling a remote port of entry in the state’s Bootheel region stopped several large groups of migrants on Tuesday — totaling more than 1,800 arrests. During the first six-months of 2018, authorities apprehended less than 11,000 migrants illegally crossing that section of the border, but in 2019 that number has already skyrocketed to more than 71,000. In response, the White House is considering tightening the standard for granting asylum to close the loopholes used by human traffickers.

Description: PHOENIX — A New Mexico county near El Paso, Texas, declared a state of emergency Thursday over migrants arriving at and being released in the region. The board of commissioners in Otero County voted unanimously on the declaration, which includes a request for Gov. Michelle Lujan Grisham, D-N.M., to deploy National Guard troops to the county, which has seen a surge of migrants starting in January. Local officials gave the state one week to take emergency action and said they will consider suing the state if nothing happens in that time. “Otero County will also consider litigation in regards to the State of New Mexico failing to follow its constitutional duties towards the people of Otero County," County Commission Chairman Couy Griffin said in the meeting. The development comes two days after Yuma, Ariz., a city on the international border, became the first city to declare a state of emergency because it lacks the resources to handle the influx of people. Commissioners in Otero County have asked that National Guard troops be sent to their region so that agents can return to the field from administrative and other tasks to carry out law enforcement work at the highway checkpoints, which were closed late last month. "Because of the crisis at the Mexican border, the Border Patrol officers who staff the highway checkpoints on U.S. 70 near the White Sands National Monument and U.S. 54 near Orogrande have been reassigned and the border checkpoints closed. This means that drug traffickers and illegal aliens can enter Otero County freely," the resolution states. Guardsmen were deployed to the region last April as a result of President Trump's executive action. However, in February, Lujan Grisham pulled the 118 troops working with Customs and Border Protection on the southern border. Otero County is comprised of around 63,000 residents and includes 6,628 square miles. The El Paso Border Patrol sector includes all of New Mexico's border and has seen the second-highest number of families arriving at and illegally crossing the southern border since October. From Oct. 1, 2018, through March 31, agents in the El Paso region apprehended 53,000 people who claimed to be traveling with a family member. Only the Rio Grande Valley sector in Texas saw more members of families arrested: 78,000. The other seven sectors along the southwest border saw anywhere from approximately 500 to 25,000 family members.

Description: YUMA, Ariz. — The southern border city of Yuma has declared a state of emergency because of the continued surge of migrants who continue to arrive in the western Arizona region, saying it lacks the resources to handle the influx of people. “Mayor: Migrants being released into the community faster than they are departing, and shelters and the staff to run them are at max capacity. A state of emergency is declared,” the city said Tuesday evening. In the first six months of fiscal 2019, Border Patrol agents have apprehended nearly 25,000 people who are members of families. In the same period a year earlier, agents in this region made around 6,500 apprehensions, roughly one-quarter of the amount this year. Yuma gives its name to one of nine sectors, or regions, on the southwest border. The Yuma sector has seen the third-most apprehensions of families this year, after the Rio Grande Valley Sector in east Texas and the El Paso Sector in West Texas. The Rio Grande Valley has seen 78,000 apprehensions of family members, three times more than Yuma. Families from Central America who illegally enter may legally claim a credible fear of returning home. Once a person makes that claim to a Border Patrol agent and has been processed, he or she is turned over to Immigration and Customs Enforcement, which detains people who are illegally in the country. Until 2015, families who illegally entered and claimed asylum were held by the agency for the duration of their legal proceedings. But a court ruling that year mandated any person who arrived with a child only be held a maximum of 20 days. Because asylum cases now take two to five years to be heard by a federal immigration judge, migrants are not able to have their case decided before being released. The White House has claimed the ruling entices families to illegally enter and claim asylum, knowing they will be released.
